In the world of offshore finance, trusts are a widely used tool for wealth structuring. They are often established as part of sophisticated financial planning and typically follow extensive legal and tax advice. Even the most carefully structured trust arrangement show ever, can face challenges during their lifetime. Families evolve, relationships change, and mistakes can occur. When these kind of pressures lead to disputes, investigations, or legal complications this can affect the integrity of a trust structure, and the matter may become what is commonly referred to as a contentious trust.

Contentious trusts are often thought to be confined to disputes between the parties, often involving litigation, but there are a variety of different situations which may be deemed contentious, including

  • Settlors, beneficiaries and / or trust structures subject to criminal and/or tax investigations
  • Insolvency affecting a settlor, beneficiary, or entity(s) within the trust structure
  • Restrictions imposed by regulatory and/or legal bodies
